1. Agreement & Scope

These Terms & Conditions (“Terms”) form a legally binding agreement between you (“you,” “your,” or “Customer”) and UNTOLD UNDERWEAR LTD LLC (“we,” “us,” or “our”).

These Terms govern your access to and use of our website, and any purchase of products from Underdays.

By using our site or placing an order, you agree to these Terms and our Privacy Policy.

We may update these Terms from time to time. The version in effect at the time of your order applies to that order.

 

 

2. Orders & Acceptance

  • You must be at least 18 years old and authorized to use the payment method to place an order.

  • Your order constitutes an offer to purchase products; we may accept or reject it for any reason (e.g., stock issues, pricing errors, or suspected fraud).

  • You’ll receive an order confirmation email after submitting your order and a shipping confirmation once your order is dispatched.

  • If we cancel your order, we will refund any payments made.

 

 

3. Prices, Taxes & Payment

  • All prices are listed in U.S. Dollars (USD) and exclude applicable sales tax unless stated otherwise.

  • Sales tax is collected where required by law, based on your shipping address.

  • Title and risk of loss transfer to you when the goods are handed over to the carrier.

  • Accepted payment methods include major credit/debit cards and other digital options displayed at checkout.

  • Payment is authorized when you place your order; if authorization fails, your order may be canceled.

 

 

4. Shipping & Fulfillment

  • Fulfillment Location: Orders are packed and shipped from our U.S. fulfillment partner located in New York State.

  • Processing time: Typically 1–3 business days, excluding weekends and holidays.

  • Delivery time: Varies by destination; estimates provided at checkout.

  • Shipping costs: Displayed at checkout; free shipping thresholds may apply.

  • Lost or damaged shipments: Once delivered to the carrier, risk transfers to you. Please contact us promptly for help with claims.

  • Incorrect address: If a package is returned to us due to an incorrect address, you may be responsible for reshipment costs.

 

 

5. Returns & Exchanges

Because Underdays offers intimate apparel, hygiene is a top priority. We accept returns and exchanges under these conditions:

  • Return window: Within 30 days of despatch.

  • Condition: Items must be unworn, unwashed, and in original packaging with all tags and hygiene liners intact.

  • How to return: Email team@theunderdays.com to request a return authorization and instructions.

  • Return shipping: We offer free returns.

  • Refunds: Processed to the original payment method within 7–14 business days after receipt and inspection.

  • Exchanges: For size or style exchanges, please email team@theunderdays.com
    Non-returnable items: Returns that don’t meet our return conditions and hygiene standards will not be refunded.

 

 

6. Defective or Incorrect Items

If your item is defective or you received the wrong product, please contact team@theunderdays.com within 7 days of delivery with your order number and photos.
We will either replace the item or issue a full refund (including shipping costs) once confirmed.

 

 

7. Prohibited Use & Resale

Underdays products are sold for personal use only. Purchasing for resale or redistribution is not allowed.
We may cancel or limit orders suspected of being for resale purposes.

 

 

8. Intellectual Property

All content on the Underdays website—including text, images, logos, trademarks, and designs—is owned or licensed by Underdays.

You may view and print material for personal, noncommercial use only.

 Any other use without written consent is prohibited.

 

 

9. Disclaimer & Limitation of Liability

  • We strive to ensure all product and website information is accurate, but errors or omissions may occur.

  • Except as required by law, Underdays disclaims all warranties, express or implied, including merchantability or fitness for a particular purpose.

  • To the fullest extent permitted by law, our liability is limited to the amount paid for the product.

  • We are not liable for indirect, incidental, or consequential damages.

  • Underdays is not responsible for delays or nonperformance caused by factors beyond our control (e.g., weather, carrier delays, natural disasters, or strikes).

 

10. Governing Law & Jurisdiction

These Terms and any disputes are governed by the laws of the State of New York, without regard to conflict of law principles.

You agree that any legal action or proceeding shall be brought exclusively in the state or federal courts located in New York County, New York.
